While Intergenerational Split-Dollar is not a new concept, the recent Tax Court case decided in February 2022, The Estate of Marion Levine vs. Commissioner of Internal Revenue Service has helped to define the proper manner in which to use the strategy.  When properly utilized, this strategy is very effective at both creating a reduction in the taxable estate of the wealthy senior generation, while also enhancing multi-generational tax planning.

This presentation will discuss split-dollar regulations under which the plan in Levine was designed, as well as the particular restrictions that were used in the Split-Dollar Agreement in this case.  We will review the various challenges the IRS made in this case pursuant to Treasury Regulation §1.61-22, I.R.C §2036 (a)(2), §2038 and §2703.  We will also discuss what differentiated this case from the Estates of Cahill and Morrissette which also involved a similar transaction.
